Airbnb & Short Term Rentals in Prince George's County

Do you have short-term rental property in Prince George's County, Maryland?

 

 

Your should be aware of recently enacted legislation affecting short-term rental operations. Often referred to as the 'Airbnb' legislation, these bills greatly restrict short-term rental operations in Prince George's County.

 

The two bills adopted by the County Council that comprise the new 'short-term' rental law are:

  • CB-10-2018, which adds a Tourist Home as a permitted accessory use to a principal dwelling use in the Zoning Ordinance, and
  • CB-11-2018 that establishes the licensing requirements, rules regulations, fees, penalties for short-term rentals within Prince George's County.

The following list includes a small portion of the numerous changes coming:

  • A short-term rental license is required.
  • Rental licenses are different from short-term rental licenses and cannot be used interchangeably.
  • Each license must be applied for separately, adhering to and satisfying the applicable standards for each license.
  • Each short-term rental license expires annually on the anniversary of its issuance.
  • Overall rental time during each calendar year is restricted to 180 days or less if owner occupied and 90 days or less if not owner-occupied.
  • The owner of the property shall collect and remit all applicable taxes.
  • Short-term rental license applicants shall:

    • Obtain and provide a copy of current liability insurance of at least $1,000,000.
    • Pay applicable fees associated with the application and approval of the license, including the initial $150 licensing fee and annual fee of $150 thereafter.
    • Provide proof of numerous property features, including off street parking, smoke and carbon monoxide detectors, and posted emergency procedures & contacts.
    • Provide proof that notice of intent to apply for the short-term rental license has been provided to neighbors, HOA, common ownership communities, and applicable municipalities.
